The editorial explained

The Court's recent hearing on the Delhi Revision (SIR) of electoral rolls has exposed a troubling asymmetry at the heart of India's voter-registration exercise. Justice Joymalya Bagchi's pointed queries probed whether a citizen's indolence or non-response to enumeration forms could permanently extinguish a constitutional entitlement as fundamental as the . The Bench, led by the Chief Justice, observed that the Election Commission of India (ECI) had erred in treating lapsed voters, those struck off merely for not returning forms, as fresh applicants compelled to file Form 6 afresh. This, the Court implied, inverts the natural order of accountability, since the onus of maintaining accurate rolls has traditionally rested with the state machinery, not the individual elector.

The deeper infirmity, as the Bench noted, lies in the SIR's very architecture, which recasts a routine of into grounds for deletion rather than updation. Why, the judges asked, could a shifted voter not simply the new address and be re-enrolled at that location, instead of being purged from the rolls altogether? Statistical evidence lent weight to this disquiet: the proportion of draft deletions attributed to being 'shifted' or 'absent' climbed from fifty-five per cent in Bihar to a staggering seventy-two per cent across subsequent States and Union Territories during Phase 3 of the exercise.

Karnataka's figures illustrate the scale of this erosion starkly. Roughly eighty-four lakh electors were deleted on the shifted-or-absent premise, yet the claims phase restored a net addition of merely 8.2 lakh names, including new voters. Consequently, the final roll fell short of the projected adult population by 64.5 lakh, a gap too large to be dismissed as incidental administrative friction. Such an outcome runs contrary to the ECI's historic of continually widening the , an ethos in the revision of 2002-03, when enumerators physically tracked shifted voters to their new residences and the Chief Electoral Officer the old and new entries rather than discarding them.

Justice Bagchi further clarified that the earlier Bihar ruling does not constitute a , and that the legality of so-called ' discrepancy' checks, permitted only as an interim arrangement in West Bengal, remains unresolved by any final adjudication. These checks, which flagged anomalies based on family size or the age gap between a voter and listed parents, enjoy no backing from any or rule, rendering them arbitrary and, in the Court's own characterisation, somewhat . In West Bengal, the fallout was large-scale , while an independent in Delhi revealed that members of the Muslim community were flagged disproportionately under this algorithm-driven filter.

The Court, however, must resist the temptation to offer only managerial palliatives, such as deadlines or displaying printed lists at block offices, remedies it has dispensed before without root causes. The errors tainting the final SIR rolls did not arise from isolated administrative lapses alone; they flowed from a structurally flawed that shifts the burden of proof onto ordinary citizens. A durable fix demands that genuinely dead or duplicate entries be purged, newly electors be added without obstruction, and voters wrongly expunged from draft rolls be reinstated without forcing them through the ordeal of fresh enrolment.

Beyond these corrective steps, larger constitutional questions loom over how the Commission conducts such revisions and, crucially, how its own members are , questions the Court will eventually have to settle if the sanctity of universal adult suffrage is to be preserved.

Questions about this topic

What is the Special Intensive Revision (SIR) of electoral rolls?

It is a detailed exercise by the Election Commission of India to verify, update and purify voter lists by removing dead, duplicate or shifted entries and adding newly eligible voters.

Why did the Supreme Court question the ECI over the Delhi SIR?

Because voters deleted for not returning enumeration forms were being forced to reapply as fresh applicants on Form 6, which the Court called an erroneous approach that burdens genuine electors unfairly.

What were the 'logical discrepancy' checks criticised in the editorial?

These were algorithm-based checks flagging voters based on family size or age gap with parents, used without any statutory backing and found to disproportionately affect minority communities.

पूरा हिंदी अनुवाद – SC Questions ECI's Flawed Voter-Roll Revision Design

Paragraph 1

The Supreme Court's recent hearing on the Delhi Special Intensive Revision (SIR) of electoral rolls has exposed a troubling asymmetry at the heart of India's voter-registration exercise.

'at the heart of' एक collocation है जिसका अर्थ है किसी चीज़ के मूल या केंद्र में।

Justice Joymalya Bagchi's pointed queries probed whether a citizen's indolence or non-response to enumeration forms could permanently extinguish a constitutional entitlement as fundamental as the franchise.

Grammar point: 'has traditionally rested with' present perfect tense है जो यह दिखाता है कि यह ज़िम्मेदारी लंबे समय से अब तक चली आ रही है।

सार: इस पूरे पैराग्राफ का सार यह है कि कोर्ट ने सवाल उठाया कि फॉर्म न भरने पर मतदाता का नाम हटाना और उसे दोबारा आवेदन करने पर मजबूर करना गलत है, क्योंकि यह ज़िम्मेदारी सरकार की होनी चाहिए न कि नागरिक की।

Paragraph 2

The deeper infirmity, as the Bench noted, lies in the SIR's very architecture, which recasts a routine change of address into grounds for deletion rather than updation.

Why, the judges asked, could a shifted voter not simply disclose the new address and be re-enrolled at that location, instead of being purged from the rolls altogether?

Statistical evidence lent weight to this disquiet: the proportion of draft deletions attributed to being 'shifted' or 'absent' climbed from fifty-five per cent in Bihar to a staggering seventy-two per cent across subsequent States and Union Territories during Phase 3 of the exercise.

Paragraph 3

Karnataka's figures illustrate the scale of this erosion starkly.

Roughly eighty-four lakh electors were deleted on the shifted-or-absent premise, yet the claims phase restored a net addition of merely 8.2 lakh names, including new voters.

Consequently, the final roll fell short of the projected adult population by 64.5 lakh, a gap too large to be dismissed as incidental administrative friction.

Such an outcome runs contrary to the ECI's historic mandate of continually widening the franchise, an ethos inherent in the intensive revision of 2002-03, when enumerators physically tracked shifted voters to their new residences and the Chief Electoral Officer reconciled the old and new entries rather than discarding them.

Paragraph 4

Justice Bagchi further clarified that the earlier Bihar ruling does not constitute a binding precedent, and that the legality of so-called 'logical discrepancy' checks, permitted only as an interim arrangement in West Bengal, remains unresolved by any final adjudication.

These checks, which flagged anomalies based on family size or the age gap between a voter and listed parents, enjoy no backing from any statute or rule, rendering them arbitrary and, in the Court's own characterisation, somewhat ludicrous.

In West Bengal, the fallout was large-scale disenfranchisement, while an independent analysis in Delhi revealed that members of the Muslim community were flagged disproportionately under this algorithm-driven filter.

Paragraph 5

The Court, however, must resist the temptation to offer only managerial palliatives, such as extending deadlines or displaying printed lists at block offices, remedies it has dispensed before without addressing root causes.

यहाँ 'it has dispensed before' present perfect tense दिखाता है कि यह काम पहले भी हो चुका है और इसका असर अभी तक जारी है।

The errors tainting the final SIR rolls did not arise from isolated administrative lapses alone; they flowed from a structurally flawed design that shifts the burden of proof onto ordinary citizens.

A durable fix demands that genuinely dead or duplicate entries be purged, newly eligible electors be added without obstruction, and voters wrongly expunged from draft rolls be reinstated without forcing them through the ordeal of fresh enrolment.

यहाँ 'be purged', 'be added', 'be reinstated' सभी passive voice में subjunctive demand पैटर्न दिखाते हैं, जैसे demand that something be done।

सार: इस अनुच्छेद का सार यह है कि कोर्ट को सतही प्रशासनिक राहत से आगे बढ़कर उस ढांचागत खामी को ठीक करना होगा जो आम नागरिकों पर सबूत का बोझ डालती है, और इसके लिए मृत-डुप्लिकेट entries हटाना, नए मतदाता जोड़ना और ग़लत हटाए गए मतदाताओं को आसानी से बहाल करना ज़रूरी है।

Paragraph 6

Beyond these corrective steps, larger constitutional questions loom over how the Commission conducts such revisions and, crucially, how its own members are appointed, questions the Court will eventually have to settle if the sanctity of universal adult suffrage is to be preserved.

यहाँ conditional structure 'if the sanctity... is to be preserved' भविष्य की शर्त दिखाता है कि कोई लक्ष्य पाना है तो क्या करना होगा।

सार: इस अनुच्छेद का सार यह है कि सुधार केवल तकनीकी स्तर पर नहीं, बल्कि Election Commission की कार्यप्रणाली और उसके सदस्यों की नियुक्ति जैसे गहरे संवैधानिक सवालों पर भी निर्भर करेगा, जिन्हें कोर्ट को अंततः तय करना होगा।
